Questions
Frequently asked questions
01What can investors do if promoters have diverted funds?
First establish the facts: where the money went, who received it and what assets it bought. That evidence supports negotiation, warranty and indemnity claims, oppression petitions, recovery and, where appropriate, criminal complaints.
02Can you help with a warranty or indemnity claim after an acquisition?
Yes. We test what was represented before the deal against what the records show, and quantify the loss so your counsel can pursue the claim.
03What if the suspicion turns out to be wrong?
Then we say so. In one family dispute, the money trail did not support the suspicion against the managing director, but it did surface frauds by others.
04Do you act for promoters as well as investors?
Yes. Promoters also commission us when they believe investors or co-promoters have acted against the company.
