In short
eDiscovery is the identification, preservation, collection, processing, review and production of electronic information for a legal matter. For Indian law firms it also means handling WhatsApp and phone data, accounting systems and documents in Indian languages, and supporting the Section 63 certificate the Bharatiya Sakshya Adhiniyam 2023 requires for computer output. Spectra Forensics runs the process end to end under counsel’s direction, from early case assessment to production and privilege logs.

Guide
eDiscovery in India: what counsel needs to know
What does the eDiscovery process involve?
Identify the custodians and data sources; preserve them (legal hold and forensic imaging); collect with a documented chain of custody; process to remove duplicates and extract text and metadata; search, cluster and thread the data for early case assessment; review for relevance and privilege; and produce in the agreed format with a privilege log. Each step is documented so the process can be defended.
How is electronic evidence made admissible in India?
Section 61 of the Bharatiya Sakshya Adhiniyam 2023 provides that electronic records cannot be refused merely because they are electronic. Section 63, which replaced section 65B of the Indian Evidence Act, sets the conditions for admitting computer output and requires a certificate to accompany it. Forensic imaging, hash values and chain-of-custody records support that certificate.
What is different about Indian matters?
Much of the relevant evidence sits in WhatsApp and phone data rather than email, in accounting packages and ERPs, and in documents written in Indian languages or mixed scripts. Custodians often use personal devices. Planning for these at the outset, rather than after an email-only collection, avoids gaps that the other side will exploit.
How does data protection affect eDiscovery?
Collections increasingly involve personal data. Obligations under the Digital Personal Data Protection Act 2023 and DPDP Rules 2025 are being phased in, with most applying from May 2027, and should be factored into collection scope, review access and any cross-border transfer. Counsel advises on the legal basis; we build the process to match it.

Frequently asked questions
Do you collect WhatsApp and mobile phone data?
Yes. Mobile devices and messaging data are imaged and processed forensically so the chats can be searched, reviewed and produced alongside email and documents.
Can you work on arbitrations seated outside India?
Yes, including arbitrations with Indian parties, custodians or data, whatever the seat.
Who does the review: your team or ours?
Either or both. We can run managed first-level review to your protocol and leave privilege and final calls to your team, or host the data so your lawyers review it themselves.
How do you protect privilege?
Engagements are usually structured through counsel, privilege is flagged during review, and privilege logs are prepared for production.
Can you collect data remotely from other cities or countries?
Yes. Remote forensic collection preserves laptops and cloud accounts without shipping devices or disrupting the business.
Do you provide an expert witness on the evidence?
Yes. We can explain the collection and processing to the tribunal and support the Section 63 certificate.
Can you review documents in Indian and foreign languages?
Yes. We review documents and chats in Indian vernacular languages and in international languages, so multilingual collections are handled within one review.
